Workhand Terms of Service

These terms ("Terms") are a contract between you and Innovative Ops LLC ("Workhand", "we", "us"). By creating an account or using the Workhand mobile app or website, you agree to these Terms.

If you're using Workhand on behalf of a company, you represent that you have authority to bind that company to these Terms.

1. Who can use Workhand

You must be at least 18 years old. You must provide accurate registration info and keep it current. You're responsible for everything that happens under your account, including the actions of your employees, contractors, and team members.

2. The service

Workhand is a project-management and field-operations app for small construction contractors. We let you:

We may add, change, or remove features over time. We won't materially reduce the value of a paid plan during your billing period without notice and a refund option.

3. Plans, billing, and refunds

Free plan. Limited features. We may change Free-plan limits at any time.

Paid plans. Pro and Team are billed monthly via Stripe. The plan auto-renews each period until you cancel. New paid subscribers receive a 14-day free trial; we won't charge until the trial ends. Cancel anytime in Settings → Billing → Manage subscription; cancellation takes effect at the end of the current period.

Refunds. All payments are non-refundable except where required by law. If you believe you were charged in error, email support@workhand.app within 30 days.

Pricing changes. If we change pricing, we'll give you 30 days' notice via email. The change applies on your next renewal.

Failed payments. If a renewal payment fails, we may downgrade you to the Free plan and lock paid features.

4. Your content

You own your data. Customer records, jobs, estimates, invoices, photos, and any content you create or upload (collectively "Customer Content") remains yours.

You grant us a limited license. To run the service, you grant Workhand a worldwide, royalty-free license to host, store, transmit, display, and process Customer Content. We use this license only to operate, maintain, and improve the service. We don't sell your data and we don't use your job content for advertising.

You're responsible for your content. You represent that your content doesn't infringe anyone's rights, isn't unlawful, and doesn't include other people's confidential information without permission.

Customer email addresses. When you send an estimate or invoice via Workhand, we email it on your behalf to the customer address you provided. You confirm you have the customer's permission to email them about the work.

6. Subcontractors and customers on Workhand

When you add a subcontractor, employee, or client as a job member:

When you send an estimate or invoice link, the recipient can view the document and accept or pay without an account. They don't agree to these Terms.

7. Third-party services

Workhand integrates with Stripe (payments), Resend (email delivery), Supabase (data hosting), Expo Push (notifications), and Cloudflare (DNS / public viewer hosting). Your use of those features is also subject to those providers' terms. We're not responsible for outages, defects, or actions of those providers.

8. Intellectual property

Workhand, the Workhand name, logo, and all software are owned by Innovative Ops LLC. We grant you a non-exclusive, non-transferable license to use Workhand for your construction business while your account is active. You may not copy, modify, or redistribute the software outside of normal use of the service.

9. Service availability

We aim for high availability but don't guarantee uptime. Workhand is provided "as is" and "as available". We may pause the service for maintenance, security, or capacity reasons.

10. Termination

By you. Cancel your subscription anytime in Settings → Billing. Delete your account in Settings → Delete account. Account deletion is permanent.

By us. We may suspend or terminate your account if you violate these Terms, fail to pay, or if your account is inactive for 12+ months. We'll give reasonable notice except where security or legal reasons require immediate action.

On termination, your access ends. We delete your personal data per the Privacy Policy. Some data (Stripe billing records, audit logs) is retained as required by law.

11. Disclaimers and limitation of liability

Disclaimers. Workhand is provided "as is" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

Liability cap. To the maximum extent allowed by law, Workhand's total liability to you for any claim is limited to the amount you paid us in the 12 months before the claim arose. We're not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or business interruption.

Critical decisions. Workhand isn't a substitute for professional financial, tax, legal, or insurance advice. Don't rely solely on Workhand for those decisions.

12. Indemnification

You agree to defend and indemnify Workhand against claims arising from your use of the service, your content, your violation of these Terms, or your violation of someone else's rights.

13. Disputes

These Terms are governed by the laws of the state where Innovative Ops LLC is registered, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located there. Both parties waive jury trial.

If any clause of these Terms is unenforceable, the rest still applies.

14. Changes to these Terms

We may update these Terms. Material changes get 30 days' notice via email or in-app notice. Continuing to use Workhand after the effective date means you accept the changes.
